The
main Achievements of NRI Sabha :-
1.
) With the persistent efforts of NRI Sabha, The Punjab
Security of Land Tenures Act 1953 has been amended by
Punjab Govt. Gazette Notification No. 14-PLA-97/55 dated
18 Dec 1997 in favour of NRIs. Now they can have
possession of their land like members of Armed Forces,
by summary procedure. They are required to file case in
the court of SDM-cum-Asstt. Collector 1st
Grade concerned. This concession is available only in
respect of the land acquired or held by a Non-Resident
Indian before the commencement of The Punjab Security of
Land Tenures (Amendment) Act 1997. This amendment came
into effect on 18.12.1997. The copy of notification is

NRI
Sabha Punjab has been thinking for speedy redressal of
grievances of NRIs. In this direction, the Sabha became
successful in getting the amendment made by the Punjab
Govt. in favour of the NRIs to get possession of their
urban properties from the tenants. The East Punjab Urban
Rent Restriction Act 1949 has been amended by the Punjab
Govt. vide Gazette Notification No. 10-Leg/2001 dated
31.5.2001 facilitating return of possession by filing a
case before the civil court having powers of Rent
Controller in respective jurisdiction. A new section 13B
has been inserted and the concession is available only
after a period of 5 years from the date of becoming
owner. The other terms and conditions are provided in
The East Punjab Urban Rent Restriction (Amendment) Act
2001 which came into force with the issue of aforesaid
Gazette Notification dated 31.5.2001. The same is

FAST
TRACK REVENUE COURTS FOR NRIs :
On
their persistent demand pursued by the NRI Sabha Punjab,
the Government of Punjab has already set up Fast Track
Revenue Courts with the object of ensuring speedy
disposal of Revenue Court cases of NRIs. The District
Revenue Officers of four Districts have been made the
Presiding Officers of these Courts in respect of the
area of their District and other Districts attached to
them for disposal of NRI cases, as under :-

All
the cases of NRI petitioners relating to correction of
Khasra Girdawari, Partition Contested/ Uncontested
mutations, Registered/Un-registered WILLs, Numbardari
Cases, Chowkidari Cases, Demarcation, Rent Suits &
Ejectment Cases under Section 6(3) of Punjab Land
Revenue Act, which were previously handled by the Courts
of SDM/Tehsildars/Naib Tehsildars ( as Collectors /
Assistant Collectors ) were/ are required to be
transferred to the respective aforesaid Fast Track
Revenue Courts. The new institution of these cases of
NRIs is also to be made in these Fast Track Revenue
Courts. According to the Punjab Government instructions
on the subject, the disposal of cases by these Fast
Track Courts was required to be reviewed by the District
Collectors & Divisional Commissioners fortnightly
and to send reports to the Headquarters.
The
work of these Fast Track Revenue Courts for NRIs was
reviewed by Divisional Commissioner Jalandhar Division
in a meeting held on 25.07.2008 in which the DROs-cum-Presiding
Officers of these Courts with their reports/suggestions
and Sh. Kamaljit Singh Hayre, President NRI Sabha Punjab
and Sh. Sucha Singh Mast, PCS (Retd), Executive Director
NRI Sabha Punjab also participated. The DRO Jalandhar
reported that out of 157 cases of NRIs
received/instituted in his court 67 cases have already
been disposed of and 90 cases are pending out of which
82 belongs to District Jalandhar and 8 to Tehsil
Phagwara District Kapurthala. Only 2 cases were reported
to have been instituted in the Fast Track Revenue Court
of DRO Nawanshahr, which were disposed of. No case was
reported to have been received in the Fast Track Courts
of DRO Moga and DRO Hoshiarpur. From these reports it
became clear that the NRIs and various Revenue Courts in
the State where the Revenue cases of NRIs are pending
are not aware of the existence of the Fast Track Revenue
Courts for the NRIs. All the NRIs are therefore, advised
to get their revenue cases relating to the matters
mentioned above, pending other Revenue Courts
transferred to their respective Fast Track Courts of
District Revenue Officers mentioned above immediately by
moving applications to the courts where the cases are
pending. For instituting any fresh case about the
revenue matters detailed above, the NRIs should go to
the respective Fast Track Revenue Courts. Such cases of
the NRIs can also be filed through their Attorneys.
